HC notice to state on MCI decision

Chandigarh/ Alive News: The decision of the Medical Council of India (MCI) on signing of all lab reports by persons registered with it or the State Medical Council has come under the judicial scanner. Acting on a petition filed by Bhiwani-based Association of Private Laboratory Technicians, the Punjab and Haryana High Court has put the state and other respondents on notice.

Taking up the plea, Justice Rakesh Kumar Jain fixed April 3 as the next date of hearing in the case. The Bench was told that the association of private laboratory technicians was aggrieved by the MCI’s decision, as per which all lab reports were to be signed and countersigned by persons registered with it or the State Medical Council.
The counsel appearing for the association submitted that MSc and PhD degree holders were not registered with the MCI, according to it. As such, they were not eligible to sign or countersign the lab reports.
Relying on an order passed by the Delhi High Court, the counsel submitted that insofar as medical reports were concerned, these could be prepared by MSc or PhD technicians. But the reports had to go to the doctor for opinion. “So far as the test is concerned, it cannot be denied,” the counsel pointed out.
