Bombay HC Stays ‘Leave India’ Notice Against Actor Imran Khan Until November 2

Mumbai/Alive News: The Bombay High Court on Tuesday granted temporary relief to actor Imran Khan by staying a ‘Leave India Notice’ issued against him by the Foreigners Regional Registration Office (FRRO). The court directed that the notice remain in abeyance until November 2.

Khan, a US citizen and Overseas Citizen of India (OCI) cardholder, had been directed to leave India by October 28 over his alleged participation in a protest against Chief Election Commissioner Gyanesh Kumar.

A division bench comprising Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna heard the matter after Senior Advocate Venkatesh Dhond mentioned the petition before it.

The case relates to Khan’s detention by Mumbai Police on October 10 during a protest at August Kranti Maidan. Demonstrators had demanded the removal of Gyanesh Kumar over the Special Intensive Revision (SIR) of electoral rolls.

The action against the actor followed a complaint by former BJP MP Kirit Somaiya, who approached the Mumbai Police and the FRRO, alleging that Khan’s participation in a political demonstration violated the conditions applicable to OCI cardholders.

Following the police communication, the FRRO issued the notice under the Immigration and Foreigners Act, 2025, warning of possible prosecution for non-compliance.

In his petition, Khan challenged the notice, arguing that it had been issued without giving him an opportunity to be heard. He also questioned the legality of the action in relation to the statutory rights available to OCI cardholders.

The High Court’s interim order allows the matter to proceed while the notice remains on hold until November 2.
